JS opened the meeting.

Continuation – 295 Pulaski Blvd. – Rocky’s Ace Hardware – Kevin Bradley
Special Permit request for additional retail space
Sitting In:  JS, BS, AP, JD and BW

The applicant requested a continuation to the meeting on February 4, 2016 (by email).

AP motion to accept.
BS second.
All in favor to allow a continuation to the February 4th meeting at 7:00 PM.

Informal – 21 Governor Avenue – Attorney Ambler
JS stated that there was to be an informal discussion with Attorney Ambler regarding abandonment and he requested it be held at the next meeting.  

Discussions

D & D Mulch – Animated Signage
JK explained this applicant has an approved sign.  It is 100 square feet.  The applicant had it animated on the first day.  He did turn it off when asked.  This business owners asked if it would be possible to come before the board for a variance to allow the sign be animated. The board discussed the many signs around town with animated LED’s.  They agreed they need more enforcement as anyone seeking a new sign must adhere to the bylaw. JK stated he would talk with the D & D owner and explain the bylaw and what they need to do to come to the ZBA.

Post Office Place – proposed 40B
The applicant for this 40B proposal has met with the BOS.  It is a friendly 40B.  JK was in attendance and gave his input; they are ready to go back to the BOS.  They wanted to visit with each board and then start the formal process.  JS thought it best to go to the other boards first and then follow the Public Hearing process for the ZBA.  He felt it is more efficient this way.  The board agreed that they (40B proposal) should seek out the other boards first and then we can have their input in front of ZBA for the upcoming Public Hearings.

Town Counsel
Jay Talerman will be in when the board has a free month to hold a question and answer type discussion on Variances and Special Permits.

Annual Report
JK will put together an Annual Report for the ZBA.  It has not been done in the past but JK felt it should be done at this point.  He will forward it to the board for their review.  

Family Apartment Permits
The board will put this discussion on hold until all members are present.

JK explained all new documents can be viewed on this internal link.  This allows JK to upload new hearing information as soon as it is received.

Cranes 101
JK spoke with Town Counsel and a new enforcement notice will be issued as they have no plan to come in and apply for a Special Permit for their business.
Varney Brothers

JK will attempt to reach them as he is still waiting for the new business plan.

All in favor to accept as amended.

Resignation
JS noted his appointment will be up in March 2016 and he will not be seeking re-appointment.  This will allow the board time to re-organize their CHR and VCHR seats and also seek a new permanent member.  The Board expressed their thanks and regrets that he will be leaving the Board.
